Personal injury compensation
Why can i claim personal injury compensation?
Someone has a legal right to claim compensation after suffering a personal injury at the fault of another person.
This is because in the law people have a degree of legal responsibility to one another. If a person does not follow these rules, and their actions are detrimental to another person, then you are in breach of your civil responsibility and are negligent.
Who will pay me my compensation?
In the UK it is a legal requirement to have insurance. This is so that you can claim compensation without having to financially harm the person who made the error. It is the insuring company's responsibility to pay out any compensation that you are awarded.
How much will the compensation be?
The amount of compensation is directly related to the actual personal injury that is suffered. The possibility of an injury, so claiming that something could have happened, is not enough.
This is because the purpose of compensation in the law is to provide an amount that puts the sufferer back in the position he would have been had he not suffered the injury, as much as is possible.
As an example, imagine that an office worker suffered a broken leg as a result of a road traffic accident that was not his fault. Now imagine that a professional footballer had the exact same injury in the exact same circumstances. The footballer would require more compensation because had he not been injured, he would be playing football and earning money when he now otherwise cannot do so.
